UK Supreme Court rules in favour of PIA in duress case against travel agency

In a landmark case, the United Kingdom's Supreme Court on Wednesday ruled in favour of Pakistan International Airlines Corporation (PIAC) in an appeal filed by a travel agency.

The issue put before the court was what constitutes economic duress, and whether such duress can arise where lawful acts or threats are made by one party in support of a demand which that party genuinely believes it is entitled to make.

The case was heard by President of the Supreme Court Lord Reed, Deputy president Lord Hodge, as well as Lord Lloyd-Jones, Lord Kitchin and Lord Burrows. The hearings took place on November 2 and 3 last year, with the judgement delivered on August 18 (today).

According to a summary shared by the court, PIA had entered into a contract with the appellant, Times Travel (UK), pursuant to which Times Travel acted as a ticketing agent to PIAC.

Times Travel was a small family-owned travel agency whose business was largely dependent on its ability to sell PIAC's tickets. By 2012, a large number of PIAC's ticketing agents had either commenced or threatened proceedings to recover substantial sums they said PIAC owed to them by way of commission.

In September 2012, PIAC gave lawful notice of the termination of its existing agency contracts and offered Times Travel a new contract.

The new contract contained a waiver by Times Travel of its claims for unpaid commission under the prior arrangements. Times Travel accepted and signed the new contract.

In 2014, Times Travel initiated proceedings to recover unpaid commission and other payments which it said were due to it under the prior contractual arrangements.

At first instance, the High Court held that Times Travel was entitled to avoid the contract with PIAC on the grounds of economic duress.

The Court of Appeal had allowed PIAC's appeal. Times Travel then appealed to the Supreme Court, which ruled in favour of PIA.

Six more die in rain-related incidents in Karachi

At least six people lost their lives in rain-related incidents on Friday as heavy rainfall wreaked havoc in Karachi, bringing up the toll in three days to 14. Following a rain forecast, different areas of the port city continued to receive moderate to heavy showers under the influence of a monsoon system that is present over Karachi. Four soldiers martyred in gun battle with terrorists in North Waziristan: ISPR

Four soldiers were martyred in North Waziristan's Hassan Khel area during an exchange of fire with terrorists who attempted to infiltrate into Pakistan from Afghanistan in the night between March 23 and March 24, the military's media affairs wing said on Thursday. According to a statement issued by the Inter-Services Public Relations (ISPR), a group of terrorists tried to infiltrate into Pakistan at midnight, but their attempt was foiled due to the "alertness and timely response of army troops". The terrorists, however, retaliated by opening fire, the statement said, adding that the soldiers "reciprocated in a befitting manner". The Opposition has decided to jointly move a no-confidence motion against National Assembly Speaker Asad Qaiser, sources said Wednesday, after two days of ruckus in the Lower House. Former PM's close aide Shahzad Akbar's name placed on ECL

The federal cabinet amended the Exit Control List (ECL) on Tuesday on the recommendation of the Interior Ministry, removing 22 names from the no-fly list and adding 10 people to it, while giving a one-time permission to three people to leave the country. Saudi princess freed after three years in jail

Saudi authorities have released a princess and her daughter who had been held without charge for nearly three years in the capital, a human rights group said on Saturday. Pakistan rejects illegal grant of IOK domicile certificates to Indians

Pakistan has categorically rejected the grant of domicile certificates of Indian occupied Jammu and Kashmir (IOK) by the Indian authorities to reportedly 25,000 Indian nationals. In a statement, Foreign Office Spokesperson Aisha Farooqui said that the certificates issued to non-Kashmiris including, among others, the Indian government officials under “Jammu and Kashmir Grant of Domicile Certificate (Procedure), 2020” are illegal, void and in complete violation of the relevant United Nations Security Council resolutions, and International law including the 4th Geneva Convention.
